Gladmans Appeal notice issued July 2024


We now received notice that the Gladmans Appeal over Lancaster City Council’s refusal of their application to build 644 houses between Hala and land north of Bailrigg Lane, will go ahead in October. Many members will have received the following from Lancaster City Council.



Let us know if you are affected by the development and would like to be involved in activities such as leafleting, social media, speech writing, or speaking. It is especially effective if those directly affected are willing to speak at Hearings or if they can provide detailed information for others to turn into speeches.

Outline planning application for the demolition of Low Hill House and the erection of up to 644 dwellings (Use Class C3), a local centre (Use Class E) of no more than 280sq m internal floorspace, a community hall (Use Class F2) of no more than 150sq m internal floorspace, public open spaces including equipped children's play areas, land re-grading, recreational routes, landscaping and sustainable urban drainage systems and creation of vehicular access from Bailrigg Lane and Hala Hill to the North

An appeal has been made to the Secretary of State on 01.07.2024, against the decision made by Lancaster City Council, in respect of the above site. The appeal is made under Section 78 of the Town and Country Planning Act 1990 against a refusal of planning permission and will be decided by means of a Public Inquiry, the date and venue of which are yet to be confirmed.  I will contact you again with this information when it becomes available.  The procedure to be followed is set out in the Town and Country Planning Appeals (Determination by Inspectors) (Inquiries Procedure) (England) Rules 2000.

 

The Inquiry has been scheduled to open on 15 October 2024 for 8 days in Lancaster Town Hall.  Full details of the arrangements will be confirmed nearer to the time.

 

For any group or organisation who wish to take an active part in the Inquiry, the opportunity is available to apply for what is known as Rule 6 status. Although unusual, there is also scope for interested individuals to take part on the same basis. Rule 6 status means that you would be able to present your evidence on a formal basis and cross examine the evidence of others. You can find guidance at the following link:

 

 

Arrangements for the Inquiry are currently being finalised by the Planning Inspectorate. These will include a pre-Inquiry conference call with the lead parties to deal with procedural and administrative matters, including how the evidence will be heard. As a Rule 6 party, it is anticipated that you would also be a part of that process. If, having read the above guidance, you wish to apply for Rule 6 status and/or have any related questions, you should contact the Planning Inspectorate immediately. If you are interested but are unable to access the guidance electronically, again, you should contact the Planning Inspectorate who will try and assist.

 

If, having read the above guidance, you wish to apply for Rule 6 status it is essential that you contact the Planning Inspectorate immediately.

 

We have forwarded all the representations made to us on the application to the Planning Inspectorate and the appellant. These will be considered by the Inspector when determining the appeal.
